The Turkish government is working continuously to strengthen the procedures that improve the reality of real estate investment in Turkey and is working to compel the implementation of any useful matter that is in the public interest, and from these decisions and procedures, the concept of energy identity for real estate has recently been circulated, which has become mandatory to apply. Real estate in Turkey, regardless of the procedures followed, whether selling, buying, or renting, and this decision to abide by them has been in effect since the beginning of the year two thousand and twenty, and accordingly, it is not possible to obtain a license for the sale or purchase of any property in Turkey without obtaining an identity Energy first.

 

Firstly: Definition of energy identity for real estate in Turkey:

The energy identity in Turkey is an official document that is issued by the Ministry of Energy and Natural Resources in Turkey or any one of its subsidiary departments, and the function of this document is to assess the efficiency of real estate in Turkey in terms of energy consumption and ensure that it achieves Conditions necessary to protect the environment from gas emissions.

 

Secondly: Contents of the energy identity document for real estate in Turkey:

This document includes information about the classification of real estate consumption in Turkey for energy and the classification of the rate of gas emissions from the property that may cause global warming, as well as a confirmation of the properties of thermal insulation in the property and the efficiency of the work of cooling and air conditioning systems.

And upon issuance of the energy ID for a property in Turkey, it remains valid for use up to ten years from the date of its first issuance and upon possession of this identity the owner of the property is allowed to obtain a license to sell or rent the property as long as the identity is valid from the date of its first issuance and on If the energy ID exceeds its validity period, the property owner must apply for a new document.

And based on the new decision issued in the year 2000, according to which it became mandatory to obtain an energy identity for real estate in Turkey, which states that this document is required as a necessary condition for completing any transaction of buying, selling, or leasing a property in Turkey, so the owner must have two copies. For the energy identity document of the property that he owns, provided that one of these copies is placed hanging at the entrance to the building or real estate, and the second copy is kept with the administration of the complex or the owner of the building in case it is one person

 

Third: Real estate in Turkey that needs an energy identity document:

According to the new law that was issued and is considered effective from the beginning of the year two thousand and twenty, it has become mandatory to obtain an energy ID for the following properties: Buildings, whether residential or commercial buildings designated for offices, companies, and public buildings such as schools, hospitals, municipalities, workshops and factories In addition to warehouses and buildings that will be used for a period of more than two years, and also buildings whose area exceeds fifty square meters.

Buildings in Turkey are classified into two categories that include each of the modern buildings, i.e. those buildings and residential complexes that have been built after a period of two thousand and eleven years, while the second type is the old buildings, which are all the buildings and complexes that were previously mentioned. It was built before the year two thousand and eleven AD.

And according to the law on the energy identity of real estate in Turkey, all buildings and real estate mentioned above are required to obtain an energy ID and it is not allowed to complete any sale or rental of these properties in the absence of an energy identity.

 

Fourthly: Conditions for obtaining an energy identity for real estate in Turkey:

Buildings are classified according to the energy identity into several types, ranging with the letter designation from A, which expresses the most efficient rating up to G, which means that the property is classified as the least efficient in terms of energy consumption and achieving the conditions for obtaining an energy identity for real estate in Turkey.

To obtain this document, it is necessary to fulfill a set of standards and conditions by the building or real estate, which can be said that the most important of which is looking at how the building or property saves energy through and the quality of the thermal insulation that the building enjoys and the thermal insulation of windows and doors In addition to the efficiency of air-conditioning, refrigeration and heating equipment, and equipment, the efficiency of lighting lamps and the degree of energy savings, the quality of the architectural structure, both internal and external to the building, is also considered during the evaluation of the building, as well as the quality of the gas and electricity installations and ventilation outlets and the extent of the ability to obtain the building Natural lighting and ventilation.

 

Fifthly: Real estate that does not have an energy identity in Turkey:

The fact that buildings in Turkey are divided into two types, the Energy Identity Law deals with each of them separately

Modern buildings are not allowed to be given a title deed or title deed unless they have an energy ID, and they are granted a specific period of time to work on obtaining the energy identity and achieving the necessary standards and conditions to obtain it.

As for old real estate, according to the law on energy identity, they can be sold, bought, or rented without the need to obtain an energy identity document for real estate in Turkey, starting from the date of two thousand and twenty and later.
